Terms of Service

Welcome to Flexin. These Terms of Service ("Terms") govern your use of the Flexin fitness tracking app and our website at flexinfitapp.com (together, the "Service"), operated by Flexin ("we," "us," or "our"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (16 in the European Union and United Kingdom) to use the Service. Users under the age of 18 must have permission from a parent or legal guardian. By using Flexin you represent that you meet these age requirements and have the legal capacity to enter into these Terms.

2. Your Account

• You are responsible for maintaining the confidentiality of your password and account credentials.
• You agree to provide accurate, current, and complete information when creating an account.
• You are responsible for all activity under your account.
• Notify us immediately at support@flexinapp.com if you suspect unauthorized access.

3. Subscriptions and Payment

Free trial

New subscribers may be offered a free trial of Flexin Premium. At the end of the trial, your subscription will automatically convert to a paid subscription at the price disclosed at sign-up unless you cancel before the trial ends.

Pricing and billing

• iOS app: $6.99 USD per month, billed through your Apple ID after the 3-day free trial.
• Web (Stripe): $4.99 USD per month, billed monthly.
• Prices may vary by region and currency.
• All subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before renewal.

Cancellation

For iOS subscribers: manage and cancel your subscription in iPhone Settings → [your name] → Subscriptions. Apple's standard refund policy applies.

For web subscribers: cancel anytime from your account settings on flexinapp.com. Cancellation takes effect at the end of your current billing period.

Refunds

iOS purchases are subject to Apple's refund policy. For web subscriptions, refund requests within 14 days of an initial purchase will be considered on a case-by-case basis. Email support@flexinapp.com to request a refund.

4. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose
• Reverse-engineer, decompile, or attempt to extract source code
• Resell, sublicense, or commercially distribute access to the Service
• Use automated tools (bots, scrapers) to access the Service
• Interfere with or disrupt the Service or servers
• Upload content that is harmful, harassing, infringing, or illegal
• Impersonate any person or misrepresent your affiliation

We may suspend or terminate your account if you violate these terms.

5. Intellectual Property

The Service, including all fitness content, designs, logos, exercise libraries, AI-generated coaching, and software, is owned by Flexin or our licensors and protected by copyright, trademark, and other laws. We grant you a limited, personal, non-transferable, non-exclusive license to access the Service for your personal, non-commercial use.

You retain ownership of progress photos, workout logs, notes, and content you create within the app. You grant us a limited license to store and display that content solely to operate the Service for you. We do not sell or share your photos with third parties for advertising.

6. Medical & Fitness Disclaimer

Flexin is not a medical device or medical service. The exercise tracking, workout suggestions, muscle activation percentages, body composition estimates, progress-photo comparisons, and AI-generated coaching are intended for general fitness and motivational purposes only. They are not medical advice, diagnosis, or treatment.

Consult a qualified physician or licensed healthcare provider before starting any exercise program, especially if you are pregnant, recovering from injury or surgery, have a heart condition, high or low blood pressure, diabetes, an eating disorder, or any other medical condition.

Strength training and other physical exercise carry inherent risks including muscle strain, joint injury, and in rare cases serious injury or death. By using Flexin you assume all responsibility and risk for your exercise activities and for any injury or harm that may result. Stop exercising immediately and seek medical attention if you experience pain, dizziness, shortness of breath, chest discomfort, or any unusual symptoms.

The muscle activation percentages shown in the dashboard are estimates derived from published electromyography (EMG) research and may not reflect your individual biomechanics or training history. They are for motivational tracking only.

6a. Progress Photos & User Content

Progress photos and other content you upload are stored in your private Flexin account and used inside the app for side-by-side comparisons and progress tracking. You can delete any photo from the Progress screen at any time; deleted photos are removed from active display immediately and from our backups within 30 days. To delete your entire account and all associated data, visit Profile → Privacy Settings → Delete Account.

7. Third-Party Services

The Service integrates with third-party services including Apple (App Store, In-App Purchases), Stripe (web payments), Vercel (hosting), and Neon (database). Your use of these services is subject to their respective terms and privacy policies.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLEXIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, OR DATA, OR FOR ANY PHYSICAL INJURY OR HEALTH CONSEQUENCES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR USD $100, WHICHEVER IS GREATER.

9a. Indemnification

You agree to indemnify, defend, and hold harmless Flexin, its owners, employees, contractors, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from (a) your use or misuse of the Service, (b) your violation of these Terms, (c) any injury or harm resulting from your physical activity tracked or suggested by the Service, or (d) your violation of any third-party right or applicable law.

9b. Arbitration & Class Waiver

Any dispute arising out of or relating to your use of Flexin will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except either party may bring a claim in small-claims court. You and Flexin waive any right to a jury trial and any right to participate in a class action or class arbitration. You may opt out of this arbitration agreement by emailing support@flexinfitapp.com within 30 days of first accepting these Terms.

10. Termination

You may delete your account at any time from Settings. We may suspend or terminate your access to the Service for violation of these Terms. Upon termination, your right to use the Service ceases immediately.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the state or federal courts located in Delaware.

12. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
